TERMS & CONDITIONS FOR SINAYA GIFT APPLICATION

By registering and / or clicking the Agree button, downloading or using the Application of Sinaya Gift, then the Customer shall be deemed to have read, acknowledged, understood and agreed to all of the terms and conditions in the Application of Sinaya Gift. In the event that the Customer does not agree to either one, part or all of the terms and conditions thereto, the Customer shall not be allowed to use the Sinaya Gift Application service.


Your instructions will be received digitally
  • All Customer’s instructions that are related with the reward will come from the Sinaya Gift mobile application.
  • The Customer will be asked to authorize the Customer’s instructions using a telephone number and password.
  • The Customer shall be fully responsible for the use and confidentiality of all types of security information used in the utilization of the Application of Sinaya Gift. Please ensure that the Customer does not tell his / her security information to other people, including Bank staff and Merchant staff.
  • The Customer understands and agrees to the method of sending information electronically that is used to transmit Customer data, including all the risks involved. The Customer hereby states that he / she agrees to free (exempt) the Bank from any and all losses that may arise.

Storage of Customer’s Personal Data
  • The Customer shall be asked to provide personal data such as account number, date of birth and telephone number recorded in the Bank system upon registering an account in the Application of Sinaya Gift.
  • The Bank shall always keep the Customer’s personal data confidential. The Customer also agrees and allows or permits the Bank to provide Customer’s personal data to third parties who have collaborated with the Bank who assist the Bank in providing services in the Application of Sinaya Gift and processing all forms of Customer activities in the Application of Sinaya Gift accordingly. In the event that the Bank collaborates with a third party in connection with the provision of Customer’s personal data, the Bank shall guarantee that the third party concerned shall also be required to keep Customer’s personal data confidential.
  • Please ensure that the information the customer provides is true, accurate, and does not violate the law.
  • The Bank shall maintain the confidentiality and security of the personal information that the Customer provides. The Bank will use Customer data in accordance with applicable regulations.
  • The Customer shall be required to notify and submit any changes to the Data to the Bank. Such changes shall only take effect if they have been accepted and / or approved by the Bank. In the event that the Bank does not receive any information regarding such data changes, the Bank will use the Customer Data recorded in the Bank system accordingly.
  • The Customer shall be required to bear all consequences and / or losses that may arise from the Customer’s negligence in updating the Data on the Bank

The Bank understands Customer
  • The Bank will always provide information regarding the Bank’s rewards / services, including whenever there are changes to the Terms and Conditions in accordance with applicable regulations.
  • In order for the Bank and Customer to understand each other, the Bank shall ask the Customer to read the entire contents of these Terms and Conditions in accordance with the specific service that the Customer will obtain so that the Customer hereby acknowledges that he / she has read all the contents of these Terms and Conditions when the Customer concerned submits the registration of the Application of Sinaya Gift, and the Customer fully understands and agrees to all the provisions in these Terms and Conditions accordingly. In the event that the Customer does not agree with the terms and / or the contents of these Terms and Conditions, or can not accurately understand the interpretation of these terms, then please do not continue these Terms and Conditions and delete the Application of Sinaya Gift from the Customer’s Device.
  • The Customer can contact Customer Service to ask any questions, submit requests, and / or file complaints at 021 - 1500 365 or email at btpncare@btpn.com or visit the BTPN Sinaya Branch. In the event that the customer wishes to submit a complaint in writing, then he / she must include evidence that supports the complaint accordingly.

  1. Definition
    • The “Bank” is PT. BANK BTPN Tbk. which is a Legal Entity in the form of a limited liability company established under the laws of the Republic of Indonesia which is engaged in the national banking.
    • “Sinaya Gift” is a mobile application for the Android and IOS operating system with the main function of serves a loyalty application for Sinaya Customers which provides the Customer access to gifts given by the Bank.
    • "Sinaya" adalah lini bisnis Wealth Management Business di Bank BTPN dengan fungsi memberikan layanan dan menawarkan serta mengelola produk yang diberikan kepada Nasabah sesuai dengan wewenang yang ditetapkan oleh Bank.
    • “Sinaya” is the Wealth Management Business line at Bank BTPN with the function of providing services and offering as well as managing products provided to Customers in accordance with the authority determined by the Bank.
    • “Partner” is another third party that is a partner of the Bank and has entered into a cooperation agreement to organize the Application of Sinaya Gift including but not limited to managing access to the Application of Sinaya Gift, managing cooperation with merchants, calculating points on the application and managing E - Vouchers.
    • “Merchant” is a third party that collaborates with a Partner and provides the services in the form of selling goods or services under the terms and conditions that are separate from the Application of Sinaya Gift
    • "Layanan Nasabah (BTPN Care)" adalah pusat layanan Nasabah yang dapat dihubungi melalui telepon atau email.
    • "Device" adalah semua perangkat elektronik, wireless, komunikasi, transmisi atau peralatan telekomunikasi, perangkat atau media yang termasuk dan tidak terbatas pada Internet, komputer atau peralatan mobile, perangkat, terminal atau sistem yang mungkin dibutuhkan untuk mengakses dan menggunakan aplikasi Sinaya Gift.
    • “Customer” is an individual who has an account at the Bank and owns product of Sinaya.
    • “Customer Service (BTPN Care)” is a customer service center that can be contacted by phone or email.
    • “Device” means all electronic, wireless, communication, transmission or telecommunication equipment, devices or media including but not limited to the Internet, computers or mobile equipment, devices, terminals or systems that may be required in order to access and use the Application of Sinaya Gift
    • “Virtual Card” is a Customer’s virtual card contained in the Application of Sinaya Gift which functions as a Customer identification which contains the information of Customer’s name, Customer’s ID Number and the amount of the Customer’s Point balance. The virtual card and the information contained in the virtual card can not be used for banking transactions and can only be used for reward redemption in the Application of Sinaya Gift.
    • “ID Number” is a Customer’s identification number that is used only for reward redemption through the Application of Sinaya Gift.
    • “Point” is the gift (reward) given to customers from the Bank which are given / awarded based on the provisions made by the Bank and can be exchanged in the form of E - Voucher.
    • “E - Voucher” is a virtual voucher contained in the Application of Sinaya Gift which can be exchanged at the Merchant in accordance with the terms and conditions of the E - Voucher Merchant
    • “Daya Feature” is a feature contained in the Application of Sinaya Gift that connects the Customer to the Daya website page.
    • “Location Feature” is a menu in the Application of Sinaya Gift which aims to provide information on the location of the Bank’s branch
    • “Message Feature” is a menu in the Application of Sinaya Gift where the Customer can receive any information or messages from the Bank.

  2. Requirements and Procedures
    1. The following requirements must be met in order to apply for the Sinaya Gift:
      1. Customer who has Sinaya products
      2. Has the authority to take legal action to sign a binding agreement with the Bank and is not prohibited / restricted from doing so under the applicable law.
    2. The registration can only be done through the Mobile Application of Sinaya Gift which can be downloaded through the App Store (Apple) and the Google Play Store. Thus, the Customer must have a smartphone with the minimum criteria required by the Bank and have an active and valid Indonesian mobile number and being registered in the Bank system in order to receive the SMS sent for the registration process. The Customer’s Device shall be required to have sufficient memory to accommodate the Application of Sinaya Gift.
    3. As a requirement, the Customer shall be required to provide his / her own account number, date of birth and active telephone number which has sufficient capacity to receive messages sent by the Bank during the registration process and is registered in the Bank’s system. The Bank shall not be responsible for the validity, ownership, activity and capacity of the telephone number concerned. An account can not be made if one of the information provided by the Customer does not match the Customer’s information registered in the Bank’s system.
    4. The Customer shall be required to create a password and enter the OTP (One Time Password) code sent through SMS from the Bank (BTPN SINAYA). The OTP code sent through SMS is confidential and it is mandatory not to provide / share it to anyone, including banks and merchants. The bank shall not be responsible for any losses arising from the provision of OTP information to other parties.
    5. After the registration process is completed then the account will be opened by the Bank in the Application of Sinaya Gift. The customer can access the services provided through the Application of Sinaya Gift, including collecting / exchanging the Points for E - Vouchers, exchanging E - Vouchers at Merchants and various other activities after the Bank completes the verification process in accordance with applicable Bank regulations.
    6. Each reward given to the Customer shall be given in the form of Points or E - Vouchers to the Customer. Every E - Voucher exchange / redemption made by the Customer shall be made based on the applicable terms and conditions made by each Merchant accordingly. The Bank shall not be responsible for any losses caused by the use of E - Vouchers or those caused by the use of Merchant goods and services obtained through E - Voucher exchange / redemption.
    7. The Points awarded to Customers can not be cashed out, being sent and can not be traded nor transferred to other parties. The Points given to the Customer shall also have an expiration date, where after the expiration date the Customer Points can no longer be used by him/her to be exchanged with E - Vouchers. The Bank has the right to deduct Customer Points in case there is an error during rewarding the Points to the Customer. The Customer Points along with the closest expiration date are listed in the balance menu along with the number of Points that will expire on that date. The Bank has the absolute right to determine the expiration date of the Points owned by Customer in the Application of Sinaya Gift.
    8. E - Voucher that has been used / exchanged at the Merchant by the Customer can no longer be reused. E - Voucher has an expiration date where after the expiration date, E – Voucher either given directly by the Bank or as the results of Point redemption made by the Customer can no longer be exchanged at the Merchant. All forms of losses caused by the use of the E - Voucher or the use of goods or services provided by the Merchant as the E - Voucher Merchant shall not be the responsibility of the Bank.
    9. The exchange / redemption of E - Voucher at the Merchant for various types of goods or services may incur additional costs which are fully the responsibility of the Customer and are part of the terms and conditions that are fully regulated by the Merchant and are beyond the power and / or responsibility of the Bank.
    10. The Daya Feature shall connect the Customer to the Daya website page which has terms and conditions separate from the terms and conditions of the Application of Sinaya Gift. All losses caused by the use of Daya application or Customer registration on the Daya.id website shall be fully regulated separately in the terms and conditions for the use of Daya.id website.
    11. The Location Feature shall provide information on the location of the Bank’s branches along with information on the branch phone numbers that can be contacted by the Customer. The Location Feature allows the Customer to connect to the Google Maps application which can provide directions for the Customer concerned to reach the branch location. The Bank shall not be responsible for any losses caused by the use of any application that provides directions to the Customer. The Bank shall not be responsible in case the Customer suffers any loss on his / her way or when contacting the branch telephone number and in the event that there is an error in the branch address found in the Application of Sinaya Gift. All costs incurred when calling the branch telephone number or travel costs to the branch shall entirely be the responsibility of the Customer.
    12. The Share feature in the application allows the Customer to provide / share link information to download the Application of Sinaya Gift to others in connection with the Application of Sinaya Gift through but not limited to short message, email and through social media. The bank shall not be responsible for any losses caused by using other applications to share information about the Application of Sinaya Gift and in the event of there is a data breach caused by the sharing of such information. The Customer understands, acknowledges and accepts that the use of the sharing feature may result in the costs that are completely beyond the responsibility of the Bank
    13. The Customer acknowledges that in case the Customer changes the Device used to access the Application of Sinaya Gift, the Customer shall be required to delete the Application of Sinaya Gift in the previous Customer’s Device. The Customer shall be fully responsible for using the application on his / her Device.
    14. The Customer agrees that the Bank has the right to close, block, or suspend the Customer’s Sinaya Gift account, among others if:
      1. The Customer Passes Away;
      2. The Sinaya Gift account owned by the Customer is suspected to have been misused, including but not limited to accommodate and / or commit any criminal acts and / or fraud has occurred or will occur related to the Sinaya Gift account and / or Customer’s banking services / facilities including those that cause harm to the community and other parties, and / or Bank;
      3. The Customer provides data / information that the Bank deems suspicious and / or provides any false / invalid / incomplete data / information, and / or is not willing to provide any data / information requested by the Bank in accordance with the terms of use of the Application of Sinaya Gift;
      4. The Customer shall be subject to certain sanctions which cause all Customer’s account at the Bank to be closed / blocked or suspended;
      5. There is an indication that the Customer’s Sinaya Gift account is being used by another party that is not the Customer him/herself;
      6. There is an indication of suspicious activity such as attempted hacking and / or the use of reverse engineering program, cracking, patching, etc. in the Application of Sinaya Gift;
      7. Other matters based on applicable regulations and Bank considerations.
    15. In the event that the Customer’s Sinaya account is to be closed, the Customer shall be required to use all the remaining E - Vouchers and Points in the Application of Sinaya Gift prior to the account closure. The Customer can not use the Points or E - Vouchers in the Customer’s Sinaya Gift account after the account has been closed either by the Bank in accordance with the Bank’s policy or at the Customer’s own request as the account owner.
    16. The Customer agrees to release / exempts the Bank from all losses, responsibilities, demands, and costs (including the cost of lawsuits) that may arise in connection with the execution of Customer’s instructions received through the Application of Sinaya Gift, unless the Customer can prove the otherwise and / or this activity is executed due to the Bank’s error / mistake.

  3. Benefit and risk

    1. The Mobile Application of Sinaya Gift is available for Customers and can be used to collect Points and exchange / redeem Points for E - Vouchers
    2. The Customer fully understands the various features of the Application of Sinaya Gift, including but not limited to collecting Points, exchanging / redeeming Points for E - Vouchers, using E - Vouchers at Merchants in accordance with Merchant terms and conditions, access to the Daya.id website with terms and conditions of website separated from the terms and conditions of Sinaya Gift, the use of branch location information, and other features

    Risk
    1. The Customer shall be responsible for ensuring that all data and instructions provided in the Application of Sinaya Gift are carried out by the Customer him/herself and are in accordance with the applicable provisions for the use of application.
    2. For each activity carried out in the Application of Sinaya Gift, the data and / or instructions provided by the Customer will be deemed correct and valid for execution which includes but is not limited to exchanging / redeeming Points and E - Vouchers at the Merchant.
    3. Customer hereby agrees that the Bank has the right to reduce Customer Points and does not carry out Customer instructions given through the Application of Sinaya Gift, including, but not limited due to the following circumstances:
      1. There is an error in awarding the number of Points to the Customer which refers to the policy for calculating the awarding of Points,
      2. The Customer’s Account at the Bank is subject to confiscation or blockage which results in the loss of Customer’s right to receive rewards,
      3. The Bank has reasons to suspect any fraud or criminal acts or there are indications of attempted hacking, patching, cracking and other acts that are beyond the terms of iuse of the Application of Sinaya Gift.
    4. In the event of a dispute between the Customer and a third party in connection with the use of E - Vouchers or other features in the Application of Sinaya Gift, the Bank has the right not to give the access to anyone until the dispute between those parties has been resolved and / or in accordance with a court decision which has permanent legal force.
    5. The Customer hereby agrees that the Bank has the absolute right to update, modify, or change any website or software (including the Application of Sinaya Gift or other applications) used to access the Application of Sinaya Gift at any time without notice and without giving any reason and also temporarily suspend the services through the Application of Sinaya Gift for a defined period for maintenance purposes, and other purposes deemed valid by the Bank.
    6. The Customer hereby agrees that the Bank has the right not to support the previous version of the application and the version of the Device used. In the event that the Customer fails to update the relevant software or use the enhanced version, the Bank shall not be responsible for any consequences thereof.
    7. The Bank shall not be responsible for the use of the Application of Sinaya Gift on any Devices that are not supported by the Application of Sinaya Gift, including but not limited to Devices that are jailbreak or rooted.
    8. The Customer understands that in case he / she neglects in completely removing the Application of Sinaya Gift on the Customer’s previous Device when the Customer changes his / her Device, the Customer’s application may be used by another party on the Customer’s Device and completely exempt / release the bank from all forms of responsibility for the Customer’s negligence.
    9. The Customer understands that the use of the Application of Sinaya Gift may cause disruption to the performance of the Customer’s Device.
    10. The Customer agrees that the Bank, Partners and affiliates, and platform devices as well as all parties that support all forms of the provision of Sinaya Gift services shall not be responsible to the Customer for any losses suffered due to the use of the Application of Sinaya Gift.

  5. Security information
    1. The security information in the form of telephone number, date of birth, account number, password, OTP (One Time Password), QR code and barcode required for registration activities, login activities, and executing every transaction which according to the Bank is required for authentication purposes. For each security information that will be determined and defined by the Customer, the Customer shall ensure to use a strong password and not making easily guessed password and personal information such as birth dates and addresses. The use of such information will be considered as Customer’s Negligence. The Customer shall be fully responsible for the security and confidentiality of all use of their Sinaya Gift Application.
    2. The security information will be confidential under the responsibility of the Customer, because the information has the same validity as a written instruction signed by the Customer, and will be treated as an explicit authorization by the Customer in order to carry out activities such as exchanging Points into E - Vouchers or exchanging / redeeming E- Vouchers at Merchants.
    3. The Bank shall not be responsible for any losses suffered by the Customer in connection with the login and registration process (whether intentionally or unintentionally) or the use of the Application of Sinaya Gift, even if the Bank has notified the possibility of losses suffered, including the incidence of losses from:
      1. Violation of Bank regulations regarding the login process using the telephone number and password
      2. The occurrence of an unauthorized access process and / or unauthorized use of electronic Devices.
      3. The access to the application of Sinaya Gift and the use of its features with a phone number and password by parties other than the Customer.
      4. Any events beyond the control of the Bank or due to improper use; and / or disconnection or termination during the logging in using a telephone number and password.
      5. Customer’s negligence to close the Application of Sinaya Gift by pressing the “log out” button or locking the Customer’s Device.
      6. There has been an abuse by other parties due to the Customer’s negligence to delete the Application of Sinaya Gift on the Customer’s previous Device
    4. The Bank shall submit a verification process to enable the Customer to carry out activities in the Application of Sinaya Gift, including for the exchange / redemption of Points and E - Vouchers.
    5. The Customer agrees to free / exempt the Bank from all losses, responsibilities, claims and fees (including legal fees) that may occur in connection with the implementation of instructions in the Application of Sinaya Gift and E - Voucher exchange activities, unless those executed due to the Bank’s error
    6. The Customer shall be responsible for obtaining and using the software and / or equipment necessary to access the Application of Sinaya Gift at the Customer’s own risk
    7. The Customer shall also be responsible for the performance and security (including without limitation taking all necessary measures to prevent any unauthorized use or access) of any equipment used by the Customer to access the Application of Sinaya Gift.
    8. The Customer shall ensure that the equipment used to access the Application of Sinaya Gift is free from any failure in electronic, mechanic, failed or corrupted data, virus on all Devices used to access the Application of Sinaya Gift, bug and / or malicious / unauthorized software by the telecommunications service provider, or the manufacturer or vendor of the relevant equipment. This shall include the followings:
      1. The use of mobile devices and / or other Customer Terminals with software in the form of the latest anti-virus, anti-malware and firewall available and the software used shall be regularly updated and run with the latest anti-virus signatures.
      2. Ensuring that the Customer does not jailbreak, root or modify the mobile device and / or other equipment, or download unauthorized applications as this can make the Device more vulnerable to viruses and malware.
    9. The Customer agrees that the Bank shall not be responsible for any electronic or mechanical failures, or corrupted data, computer viruses, bugs and / or other harmful software of any kind that may arise from the services provided by relevant internet service providers or service providers information.
    10. The Customer shall be responsible for the safety of the E - Vouchers and Points owned by the Customer in the Application of Sinaya Gift.
    11. The Points and E - Vouchers will be awarded with a specified expiration date. The expiration date is the time day printed on the E - Voucher and on the balance menu for Points. After the Points and / or E - Vouchers have expired, Customer’s access to the E - Vouchers and Points concerned can no longer be used by the Customer.
    12. By using the Application of Sinaya Gift, the Customer understands that all communications and instructions from the Customer received by the Bank through the Application of Sinaya Gift will be treated as valid evidence even though they are not made in the form of a written document or issued in the form of a signed document, and, accordingly, the Customer agrees to indemnify and release the Bank from all losses, responsibilities, lawsuits and expenses (including legal fees) that may arise in connection with the execution or use of the Application of Sinaya Gift by the Customer, unless the error in execution of the instructions is caused by the fault or negligence of the Bank.

  6. Recording / Logging
    1. The recording of every activity that occurs in the Application of Sinaya Gift which shall be the basis for the Bank and shall cause any changes to the Point balance or the use of E – Vouchers, will be given in a format deemed appropriate by the Bank.
    2. The Customer can see the activity of adding or reducing the Points on the balance menu in the application.
    3. In the event that the Bank does not receive any complaint from the Customer within 7 (seven) working days after the activity recorded on the Customer’s Application of Sinaya Gift, the Customer shall be deemed to agree with the information contained in the activity log in the Application of Sinaya Gift.
    4. The calculation of Points awarding and exchanging Points into E - Vouchers:
      1. The Bank has the right to determine the reward calculation in accordance with the applicable Bank reward program provisions.
      2. The Bank has the right to deduct Customer Points if there is an error in calculation and / or Points award to the Customer.
      3. The Bank has the right to determine the number of Points that the Customer needs to exchange to receive an E - Voucher
      4. The Points shall be given and can be used by Sinaya customers only.
      5. The Customer shall not be entitled to receive any rewards in the form of Points or E - Vouchers in case the reward concerned has not been given through the Application of Sinaya Gift, the Customer has closed all of his / her accounts at the Bank, either at the Customer’s own request or due to Bank policy.
      6. The time required for the calculation and process of Points awarding to the Customer shall fully refer to the Bank’s policy

  7. Fee
    1. There are no bank fees or application fees incurred for using the Application of Sinaya Gift.
    2. The Bank shall not be responsible for fees arising from the followings:
      1. Fees or taxes for goods and / or services imposed by the Merchant of E – Voucher
      2. Operator fees charged for short messages or other costs that arise for the use of sharing, navigation function, contacting branches or Customer Service (BTPN Care) through email and telephone or the opening of the Daya.id web.
      3. Fees charged by telecommunication operators to access the Application of Sinaya Gift.

  8. Applicable law and jurisdiction
    1. Interpretation and implementation of these Terms and Conditions shall be governed by and subject to the applicable laws in the Republic of Indonesia.
    2. For any matters related to the Terms and Conditions and all of their consequences, the Customer will choose a Common and permanent legal domicile at the secretariat office of the District Court of South Jakarta without any prejudice to the Bank’s right to file a lawsuit or claim against the Customer on other courts in Indonesia in accordance with the applicable laws and regulations.
    3. The Customer and the Bank agree to override the provisions in Article 1266 of Indonesian Civil Law.

  9. Representation and authority
    1. The Customer hereby declares that any electronic data, description and instructions of the Customer on the application and / or services / facilities used by the Customer, various other supporting data and information related to the registration of the Sinaya Gift account and / or services / facilities used by the Customer, as well as the authority given by the Customer to the third party (if any) as well as the authority given to the Bank are valid and legal and also binding on all types of activities thereto. The Customer shall be required to immediately provide information to the Bank related with any changes in the name, telephone number, and other matters that deviate / differ from the data / description previously provided by the Customer to the Bank. The Customer’s negligence in notifying such changes to the Bank shall be full responsibility of the Customer
    2. The Customer hereby declares that:
      1. The Bank has the right to test the validity of the data provided by the Customer at the time of registering a Sinaya Gift account or applying for Bank facilities / services or similar applications; and also has the right to request additional data or information required by the Bank.
      2. The Bank has provided an adequate explanation on the characteristics of the reward and the Sinaya Gift Application that will be used, and the Customer has understood all the consequences of using the Application of Sinaya Gift, including the benefits, risks, costs incurred in connection with using the Application of Sinaya Gift
    3. The Customer agrees to allow the Bank to provide and / or distribute Customer’s personal data to and / or representatives and / or the parent company and / or, shareholders and / or affiliated companies and / or its third party Partners who have collaborated with the Bank, for the purpose of opening a Sinaya Gift account, administration and / or services in order to provide and improve services to Customers.
    4. In addition to the aforementioned provisions, the Customer hereby authorizes the Bank to disclose information related to the Customer, including but not limited to information regarding the number of Points or special matters related to the Customer’s Sinaya Gift account to the Controlling Shareholders / current Controlling Shareholders, the Bank’s subsidiaries and affiliates
    5. The Customer hereby declares that the he / she has understood and is fully aware of all the risks and consequences arising from the use of the Application of Sinaya Gift and is fully responsible for the use of the rewards given to the Customer, including in case of any misuse of the Sinaya Gift account, Points and E - Vouchers for any reason whatsoever.
    6. The Customer hereby declares that he / she is willing to be contacted and / or received any kind of communication by the Bank through the Application of Sinaya Gift or Customer’s personal communication means, to convey any information (including those related with the Points and E - Vouchers), from Monday to Saturday outside of national holidays at 08.00 - 18.00 local time.
    7. The Customer hereby declares that the Bank is exempted against any claims / lawsuits for compensation arising from failure of system and / or communication facilities caused by external factors beyond the Bank’s control
    8. The Customer hereby declares to be subject to and bound by these Terms and Conditions and the PT. BANK BTPN Tbk Customer Terms and Conditions (“Terms and Conditions”) the terms and conditions associated with the Customer’s Sinaya Gift account and / or facilities / reward services that will be received by the Customer, such as the laws, regulations and Bank’s attorney in force in the Republic of Indonesia, regarding the provisions stipulated by the Republic of Indonesia in connection with banking facilities / services provided by the Bank to the Customer (including but not limited to the process and activities of using rewards through electronic media) .
    9. The Customer agrees and acknowledges that the Bank has the authority to improve, change or complete these Terms and Conditions in accordance with the applicable provisions. Any changes, additions or updates to these Terms and Conditions will be socialized through the Customer’s email or other means of communication / information and the Customer shall be bound by such changes in the future accordingly.
    10. The Customer agrees to receive notifications through electronic means in accordance with the applicable laws, these Terms and Conditions, as well as other notifications in connection with Customer’s use of Sinaya Gift. The electronic means shall include, but not limited to, electronic mail, or displayed on the pages of the Bank’s website, or on other Bank-owned applications, or through the wireless communication means. The above terms, agreements and notifications will be deemed accepted upon being published.
    11. The Customer hereby agrees that he / she shall be required to provide additional information and or documents requested by the bank in connection with the transaction including customer profile if required when exchanging the Customer’s E - Voucher.
    12. By reading, understanding and agreeing to these Terms and Conditions, the Customer binds him / herself to all of these Terms and Conditions, and all the terms and conditions set by the Bank and also states that the Bank has provided sufficient explanation in connection with the characteristics of the rewards or Bank services provided through the Application of Sinaya Gift which will be used by the Customer and the Customer has understood and acknowledged all the consequences of using such reward and / or the Application of Sinaya Gift service, along with the benefits, risks and costs attached to the E - Voucher or other services related to the provision of rewards.

  10. Force Majeure
    1. The Customer will release the Bank from any and all claims, in case the Customer is unable to use the Application of Sinaya Gift, either partially or completely due to any events or causes that are beyond the control or ability of the Bank and its affiliates, including but not limited to natural disasters, wars, riot, hardware condition, failure of electronic or transmission infrastructure system, power failure, telecommunication disturbance or other matters stipulated by Bank Indonesia or Financial Services Authority. After an incident that causes the Customer to be unable to use the Application of Sinaya Gift, the Sinaya Gift service can be accessed again within a period of time in accordance with the terms and conditions of the Bank and its affiliates relating to the provision of Application of Sinaya Gift services

  11. Question and complaint
    1. The Customer can contact Customer Service to ask any questions, submit requests, and / or file any complaints at 021-1500-300 or email to btpncare@btpn.com. In the event that the Customer wishes to submit a complaint in writing, he / she shall include evidence that supports such complaint accordingly.
    2. The Bank will conduct an examination / investigation / follow-up on the complaints in accordance with the policies and procedures applicable to the Bank.

These terms and conditions is made in compliance with the laws and regulations, including the regulations of the Financial Services Authority

These Terms and Conditions are made in Bahasa Indonesia and English. In the event of there is a difference in interpretation between the Bahasa Indonesia text and the English text of these Terms and Conditions, the text in Bahasa Indonesia will prevail.
